1. Acceptance of Terms

By accessing or using FabricSnap ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you must not access or use the Service. These Terms constitute a legally binding agreement between you and FabricSnap.

2. Description of Service

FabricSnap is an AI-powered fabric identification service that analyzes uploaded images of textiles to provide estimated information such as GSM weight, fabric composition, weave pattern, and care instructions. All results are AI-generated estimates and are provided for informational purposes only.

3. User Accounts

  • You must provide accurate and complete information when creating an account
  • You are solely responsible for maintaining the security and confidentiality of your account credentials
  • You are responsible for all activities that occur under your account
  • You must notify us immediately of any unauthorized use of your account
  • You must be at least 13 years of age to use this Service

4. Subscriptions and Payments

FabricSnap offers both free and paid subscription plans. By subscribing to a paid plan, you agree to the following:

  • Subscription fees are billed on a recurring basis (monthly or annually) and are non-refundable except as required by law
  • You authorize us to charge your payment method on a recurring basis
  • You may cancel your subscription at any time through your account settings
  • Cancellations take effect at the end of the current billing period; no partial refunds are provided
  • We reserve the right to change pricing with reasonable notice

5. Acceptable Use

You agree not to:

  • Upload content that is illegal, harmful, offensive, or violates the rights of others
  • Attempt to reverse-engineer, decompile, or otherwise extract the AI models, algorithms, or source code
  • Use the Service to develop competing products or services
  • Abuse rate limits, use automated scripts, or attempt to overwhelm the Service
  • Share your account credentials with third parties or allow multiple users on a single account
  • Use the Service for any unlawful or unauthorized purpose

6. Uploaded Content

You retain ownership of images you upload to FabricSnap. By uploading images, you grant us a non-exclusive, worldwide, royalty-free license to process, analyze, and store them solely for the purpose of providing the Service. You represent and warrant that you have all necessary rights to upload the content and that it does not infringe on any third-party rights.

7. AI Analysis Disclaimer

FabricSnap uses artificial intelligence to analyze fabric images. All AI-generated results are estimates only and are provided "as is" without any warranty of accuracy, completeness, or fitness for a particular purpose. Results may vary based on image quality, lighting, and other factors. You acknowledge that:

  • AI results should not be relied upon as the sole basis for any commercial, manufacturing, safety, or health-related decisions
  • We do not guarantee the accuracy, reliability, or completeness of any analysis
  • You assume all risk associated with your use of and reliance on the analysis results
  • We shall not be liable for any losses, damages, or costs arising from reliance on AI-generated results

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FABRICSNAP, ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR TEN US DOLLARS ($10), WHICHEVER IS GREATER.

10. Indemnification

You agree to indemnify, defend, and hold harmless FabricSnap and its owners, officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any rights of any third party; or (d) any content you upload to the Service.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising under or in connection with these Terms shall be resolved through good-faith negotiation. If a resolution cannot be reached, the dispute shall be submitted to binding arbitration in accordance with applicable rules, and you waive any right to participate in a class action lawsuit or class-wide arbitration.

12. Termination

We reserve the right to suspend or terminate your account at our sole discretion, with or without notice, for conduct that we determine violates these Terms or is harmful to other users, us, or third parties. You may delete your account at any time. Upon termination, your right to use the Service ceases immediately, and we may delete your data in accordance with our Privacy Policy.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and FabricSnap regarding your use of the Service and supersede all prior agreements and understandings.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by updating the "Last updated" date. Your continued use of the Service after any changes constitutes your acceptance of the new Terms. If you do not agree with the revised Terms, you must stop using the Service.
